Terms of Service

Last updated: 23 August 2026. These terms apply to your use of this website and to services provided by Vivid Commerce Co.

Acceptance of these terms

By using this website or engaging Vivid Commerce Co. ("we", "us") for services, you agree to these terms. If you do not agree, please do not use the site or our services.

Our services

We provide e-commerce growth services including store development, SEO, paid advertising, email and SMS marketing, conversion rate optimisation, creative, brand strategy, and analytics. The specific services, deliverables, timeline and fees for any engagement are set out in a separate proposal, scope of work or plan confirmed with you before work begins. Where those documents conflict with these terms, they take precedence for that engagement.

Enquiries and no engagement until confirmed

Submitting the contact form or consultation popup, or exchanging emails or messages with us, does not create a binding engagement. Work starts only once scope and commercial terms are agreed in writing.

Fees and payment

Listed plan prices are recurring monthly fees unless stated otherwise, and are quoted in USD excluding any applicable taxes. Project-based and performance-aligned engagements are priced individually and confirmed before services commence. Invoices are due as stated on the invoice; we may pause work on overdue accounts.

Client responsibilities

  • Provide timely access, assets, approvals and accurate information.
  • Cover your own operating expenses — advertising and media spend, platform fees, themes, apps, software subscriptions, inventory, shipping and domains.
  • Ensure your products, claims and content comply with applicable law.

No guarantee of results

Case studies, metrics and examples shown on this site are illustrative of past work or of what is achievable, and are not a promise of future results. Marketing performance depends on factors outside our control, including your product, pricing, market, platform policies and ad auction dynamics. We do not guarantee specific revenue, traffic, ranking, ROAS or profit outcomes.

Third-party platforms

Our work often relies on third-party platforms such as Shopify, WooCommerce, Wix, Squarespace, Google, Meta, TikTok and email or SMS providers. We are not responsible for their availability, policy changes, pricing, account decisions or outages.

Intellectual property

This website, our logo, and our content, frameworks and templates remain our property. Deliverables produced specifically for you transfer to you once related fees are paid in full. We may reference the engagement and non-confidential results in our portfolio unless you ask us in writing not to. Store names and logos shown as platform examples belong to their respective owners and are displayed for illustration only — they do not imply any client relationship or endorsement.

Confidentiality

Each party will keep the other's non-public business information confidential and use it only for the purposes of the engagement.

Termination

Either party may end an ongoing monthly engagement with reasonable written notice as set out in the applicable proposal. Fees for work already performed remain payable.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, including lost profits, revenue or data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. The website and its content are provided "as is" without warranties of any kind.

Acceptable use of this site

Do not attempt to disrupt, scrape at scale, reverse engineer, or gain unauthorised access to this site, and do not submit unlawful, misleading or abusive content through our forms.

Changes and contact

We may update these terms; the current version is always posted here. Questions? Email williamszoe422@gmail.com.
